Terms and Conditions - Common Thread Travels LLC

By engaging the services of Common Thread Travels LLC ("the Agency"), you ("the Client") agree to be bound by the following terms and conditions. Please read these terms carefully before making any bookings.
1. Agency Role
Common Thread Travels LLC acts as an intermediary between the Client and various third-party suppliers, including but not limited to airlines, hotels, tour operators, cruise lines, car rental agencies, and insurance providers (collectively referred to as "Suppliers"). The Agency facilitates bookings and arrangements for travel services but does not directly provide these services. As such, the Agency isn't liable for the actions, errors, omissions, negligence, or willful misconduct of these Suppliers.
2. Client Responsibilities
- Travel Documents: The Client is solely responsible for ensuring that all necessary travel documents, including but not limited to passports, visas, entry/exit requirements, health certificates, and other required documentation, are valid, up-to-date, and comply with the regulations of the countries being visited and transited. For international travel, the Client's passport must be valid for at least six (6) months beyond their intended travel dates. For domestic travel within the United States, the Client is responsible for ensuring they possess a valid form of government-issued photo identification that meets the Real ID requirements, as mandated by the U.S. government. The Client should verify these requirements well in advance of travel. The Agency won't be held responsible for any issues, delays, or denied boarding or entry resulting from the Client's failure to possess the required travel documents.
- Check-In Times: It's strongly suggested that the Client check in for domestic flights at least two (2) hours prior to the scheduled departure time and for international flights at least three (3) hours prior to the scheduled departure time.
- Information Accuracy: The Client is responsible for providing accurate and complete information to the Agency for all bookings, including names, dates of birth, contact details, and any special requests. The Client is responsible for reviewing and verifying the accuracy of all booking confirmations and travel documents upon receipt.
- Compliance with Laws: The Client is responsible for complying with all applicable laws, regulations, and customs of the countries being visited.
- Travel Insurance: The Agency strongly recommends that the Client purchase comprehensive travel insurance to cover unforeseen circumstances such as trip cancellation, interruption, medical emergencies, baggage loss, and other potential risks. The Client acknowledges that the decision to purchase travel insurance is their sole responsibility.
- Food Allergies and Sensitivities: Common Thread Travels LLC makes every effort to inform Suppliers of any gluten sensitivities or other food allergies and sensitivities communicated by the Client. However, the Agency isn't responsible for any adverse reactions or complications the Client may experience due to consuming food at recommended facilities, during tours, or at any other point during their travel. It is the Client's sole responsibility to directly inform all necessary parties (e.g., restaurants, airlines, tour operators, hotel staff) about their specific food allergies, intolerances, or dietary restrictions at the time of service.
- Group Rates: The Client understands that any quoted group rates are based on a specific minimum number of travelers. Should the number of travelers fall below this required threshold, the price for the travel arrangements is subject to increase to reflect the change in group size. The Client will be notified of any such price changes.
- Flight Changes/Cancellations: To change or cancel your flight itinerary, you must do so prior to your originally scheduled departure. No value remains after departure.
- Hotel and Car Reservations: If you are holding guaranteed hotel or car reservations you wish to cancel, you must contact the vendor directly, adhering to their1 specific cancellation policy. We're not responsible to pay you for any loss you incur due to your failure to travel or your failure to follow the change or cancel policies of any travel vendor.
3. Fees and Payments
- Service Fees: The Client agrees to pay a non-refundable service fee starting at $150 per booking. This fee covers the Agency's time and expertise in researching, planning, and coordinating the Client's travel arrangements. The planning fee may be waived at the sole discretion of the Client's travel advisor. The specific planning fee applicable to the Client's booking will be communicated and agreed upon prior to the commencement of services.
- Additional Fees: The Client acknowledges that there may be additional fees associated with booking specific aspects of the agreed-upon itinerary, such as airfare, specific tours, or other services. These fees will be clearly disclosed in the invoice provided to the Client.
- Payment Schedule: The Client agrees to make all payments for travel arrangements according to the schedule communicated by the Agency. Failure to make payments by the agreed-upon deadlines may result in the cancellation of the booking and forfeiture of any prior payments.
- Forfeiture of Trip: If the Client fails to make payments promptly as per the agreed-upon schedule, the Agency reserves the right to cancel the trip, and the Client will forfeit the booking and any payments made to date.
- Cancellation Policy: We reserve the right to charge processing fees in the event of refunds, cancellations, and other services.
- Price Changes: The Client acknowledges that prices for travel arrangements are subject to change due to factors beyond the Agency's control, including but not limited to fuel surcharges, currency exchange rate fluctuations, and changes in Supplier pricing. Such price changes may occur up until the final payment is made. Airline ticket prices are not guaranteed and may change until paid in full. The Agency will make reasonable efforts to notify the Client of any significant price changes.
- Changes to Itinerary: The Client is permitted three (3) major changes to the agreed-upon travel itinerary without incurring additional planning fees. Major changes include alterations to the destination, hotel choice, airline, train, or ship reservations, or prepaid tours. Restaurant reservations and other minor changes can be accommodated within a reasonable amount of time prior to departure without incurring a fee. For any subsequent major changes (more than two), the Client will be responsible for additional planning fees, which will be communicated to the Client at the time of the request. Furthermore, the Client will be responsible for any additional costs incurred as a result of all itinerary changes, including but not limited to Supplier change fees and any difference in price.
- Payment Processing: If Common Thread Travels LLC is the merchant on your credit card transaction, please bear in mind that our services consist of counseling and facilitating the sale and paying the Supplier. If a Supplier doesn't provide the service or ceases operations, your recourse is against the Supplier, not us. You agree not to initiate a chargeback against us or a refund request that isn't authorized by this Agreement and to pay any and all legal fees incurred by us in disputing any such claim for refund.
4. Limitation of Liability
To the fullest extent permitted by law, Common Thread Travels LLC shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages, losses, or expenses arising out of or in any way connected with the Client's travel arrangements, including but not limited to:
- Delays or cancellations caused by airlines, hotels, tour operators, or other Suppliers.
- Weather-related cancellations or delays.
- Other travel delays or cancellations beyond the Agency's direct control, including but not limited to acts of God, natural disasters, political unrest, strikes, or pandemics.
- Errors, omissions, or misrepresentations made by Suppliers.
- Personal injuries, accidents, illnesses, or death occurring during travel.
- Loss of or damage to personal property.
- Changes in itineraries or services imposed by Suppliers.
- Financial default or insolvency of Suppliers.
- Adverse reactions or complications due to food allergies or sensitivities.
The Client acknowledges that any recourse for the aforementioned issues lies directly with the relevant Supplier.
5. Claims
The Client must present any claims against Common Thread Travels LLC within thirty (30) days of the completion of travel. Any such claim must be submitted in writing and any legal action related to such claim must be initiated and maintained exclusively in the courts located in Coweta County, Georgia. The Client hereby irrevocably submits to the personal jurisdiction of such courts.
6. Force Majeure
The Agency shall not be liable for any failure or delay in performing its obligations under these Terms and Conditions to the extent that such failure or delay is caused5 by events beyond its reasonable control, including but not limited to acts of God, war, terrorism, civil unrest, strikes, natural disasters, pandemics, government regulations, or disruptions in essential services.
7. Governing Law and Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms and Conditions shall be brought exclusively in the state or federal courts located in9 Georgia, and the Client hereby irrevocably submits to the personal jurisdiction of such courts, with the specific venue being Coweta County, Georgia for claims against the Agency.
8. Entire Agreement
These Terms and Conditions constitute the entire agreement between the Client and Common Thread Travels LLC and supersede all prior or contemporaneous communications and proposals, whether oral or written, relating to the subject matter herein.
9. Severability
If any provision of these Terms and Conditions is held to be invalid, illegal, or unenforceable for any reason, such provision shall be struck and the remaining provisions shall continue in full force and effect.
10. Modification of Terms
The Agency reserves the right to modify these Terms and Conditions at any time without prior notice. The latest version of the Terms and Conditions will be posted on the Agency's website or otherwise made available to the Client. The Client's continued use of the Agency's services after any such modifications constitutes acceptance of the revised Terms and Conditions.
By proceeding with a booking through Common Thread Travels LLC, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
